Other Policies

Most software packages are accompanied by license agreements specifying the conditions of use. Even with shareware or freeware, there may be some minimal conditions of use.

Generally, authorized use is limited to the owner of the package. Site licenses or volume purchase agreements are software license agreements that extend the authorized use of software to groups defined by some sort of affiliation. Software packages purchased under such agreements are generally cheaper per copy than packages purchased individually.

The following guidelines govern our actions with respect to software site licenses or volume purchase agreements for software.

We will consider the acquisition of software license or volume purchase agreements for software products that are:

  • compatible with established information technology guidelines, directions, architectures and standards, and are
  • of interest to a broad enough community to achieve the economic benefits of a software license or volume purchase agreement.

Some software licenses come with restrictions expressed on the basis of:

  • use (e.g. research)
  • type of user (e.g. University of Toronto employee, researcher)
  • equipment (e.g. machines identified by serial number)
  • location of use (e.g. on campus, specific department)
  • owner of equipment (e.g. U of T-owned)
  • exclusivity (e.g. must be used on all U of T machines).

We will endeavor to negotiate the least restrictive agreements.

Some volume purchase opportunities are available only if the institution commits to buying a prescribed minimum number of copies, or only if the institution pays a large (often yearly) fee up front. We will commit to these types of agreements only after matching financial commitments from interested parties on campus have been received.

We will attempt to recover the direct costs of licenses unless an explicit decision has been made to subsidize the license. We will aim to recover costs in the year that these are expended but, in some cases, it may have to recover costs over a longer period of time.

We will levy a nominal fee for the administration of software licenses and, in certain cases, for the costs of supporting the product.

We will continue to renew annual or term license agreements for products so long as the economic benefits of such agreements continue. No continuation of a license should be implied at the time of initial acquisition and distribution of a license.

 

Terms & Conditions

Adobe Products

These software are available to University of Toronto employees in accordance with the license agreement between the University and Adobe Systems Canada. As a recipient of the products, I agree that I will install each product only on the number of machines a license has been purchased for. I will not copy or allow copies of the software to be made, except for my own backup purposes. I acknowledge that should any copying occur, I am subject to any legal proceedings which may ensue. I further agree that my use of this software will be only for activities sanctioned by the University of Toronto and that I will not use this product for any commercial use. I understand there will be no technical support from the University of Toronto or Adobe Systems Canada for these software.

IBM Products

These software products are available to University of Toronto employees in accordance with the licence agreement between the University and Orion. These products are licensed on a yearly basis and their continued use is subject to the renewal of the licences with Orion. and payment of a yearly fee. As a recipient of the products indicated above, I agree that I will install each product only on the number of machines shown on this form or attached list. I will not copy or allow copies of the software to be made, except for my own backup purposes. I acknowledge that should any copying occur, I am subject to any legal proceedings which may ensue. I further agree that my use of this software will be only for activities sanctioned by the University of Toronto and that I will not use this product for any commercial use. I understand there will be no technical support from the University of Toronto or Orion for these software.

MathWorks Products

These software are available to University of Toronto employees in accordance with the license agreement between the University and Mathworks Inc. The license requires an initial payment and renewal payments for following years. This guarantees the licensee support and all upgrades for the duration of the agreement. Use on a second machine at home is allowed. I agree that I will install each product only on the number of machines that licenses have been purchase for. I will not copy or allow copies of the software to be made, except for my own backup purposes. I acknowledge that should any copying occur, I am subject to any legal proceedings which may ensue. I further agree that my use of this software will be only for activities sanctioned by the University of Toronto and that I will not use this product for any commercial use, nor will I transfer this product to another machine without notifying the Information Commons. I understand there will be no technical support from the University of Toronto for these software.

Microsoft Products

These software products are available to University of Toronto employees in accordance with the Microsoft Select License for Academic between the University and Microsoft Corporation. As a recipient of the products indicated above, I understand these licenses are held by my department and remain university property, and are not personally owned. I agree that I will install each product only on the number of machines for the quantity purchased. I will not copy or allow copies of the software to be made, except for my own backup purposes. I acknowledge that should any copying occur, I am subject to any legal proceedings which may ensue. I further agree that my use of this software will be only for activities sanctioned by the University of Toronto and that I will not use this product for any commercial use. I understand there will be no technical support from the University of Toronto or Microsoft Corporation for these software. Software patches and upgrades are used at my own risk. General support can be found at www.support.microsoft.com.

SAS Products

This software is available to University of Toronto employees and registered students in accordance with the license agreement between the University and SAS Institute. This product is licensed on a yearly basis and its continued use is subject to the renewal of the license with SAS Institute and payment of a yearly fee. As a recipient of the product indicated above, I agree that I will install only on the number of machines based on the quantity purchased. I will not copy or allow copies of the software to be made, except for my own backup purposes. I acknowledge that should any copying occur, I am subject to any legal proceedings which may ensue. I further agree that my use of this software will be only for activities sanctioned by the University of Toronto and that I will not use this product for any commercial use. I understand there will be no technical support from the University of Toronto or SAS Institute for this software.

Symantec Products

This software is available to University of Toronto employees in accordance with the license agreement between the University and Symantec Corporation. As a recipient of the product indicated above, I agree that I will install only on the number of machines based on quantity purchased. I will not copy or allow copies of the software to be made, except for my own backup purposes. I acknowledge that should any copying occur, I am subject to any legal proceedings which may ensue. I further agree that my use of this software will be only for activities sanctioned by the University of Toronto and that I will not use this product for any commercial use. I understand there will be no technical support from the University of Toronto or Symantec Corporation for this software.

Wolfram Products

These  software are available to University of Toronto employees in accordance  with the license agreement between the University and Wolfram Research  Inc. The license requires an initial payment and renewal payments for  the two following years. This guarantees the licensee support and all  upgrades for the duration of the agreement. In case of Windows,  Macintosh, and Linux licenses, use on a second machine at home is  allowed. I agree that I will install each product only on the number of  machines based on the quantity purchased. I will not copy or allow  copies of the software to be made, except for my own backup purposes. I  acknowledge that should any copying occur, I am subject to any legal  proceedings which may ensue. I further agree that my use of this  software will be only for activities sanctioned by the University of  Toronto and that I will not use this product for any commercial use. I understand there will be no technical support  from the University of Toronto for these software.
